1. Acceptance of Terms
These Terms are a legally binding agreement between you (the “Driver-Partner”) and SheDrives Limited (RC 9225367) (“SheDrives”, “we”, “us”, or “our”).
By registering on the SheDrives Drivers App (“the App”), you confirm you have read, understood, and agreed to these Terms. If you do not agree, do not use the App.
These Terms are governed by Nigerian law, including the Federal Competition and Consumer Protection Act 2018 (FCCPA), the Nigeria Data Protection Act 2023 (NDPA), and the Arbitration and Mediation Act 2023 (AMA).
2. Key Definitions
The SheDrives mobile application available on iOS and Android.
An independent, self-employed female contractor who uses the Platform to offer transportation services to Riders.
SheDrives’ full technology system — the App, dashboards, and any other tools we make available.
A person who uses the Platform to request and receive transportation services.
A single completed or attempted journey arranged through the Platform.
The Federal Road Safety Corps.
The Nigeria Revenue Service.
Federal Competition and Consumer Protection Act 2018.
Nigeria Data Protection Act 2023.
3. Your Status — You Are Not an Employee
You are an independent, self-employed contractor. You are NOT an employee, worker, agent, or partner of SheDrives. SheDrives is a technology platform, not a transport company.
This means:
- You set your own working hours and can decline any Trip request.
- You may use other ride-hailing platforms at the same time.
- SheDrives does not guarantee a minimum number of Trips or a minimum income.
- You are responsible for your own tax obligations, vehicle maintenance, and insurance.
- Nothing in these Terms creates an employment relationship.
4. Who Can Join as a Driver-Partner
4.1 Personal Requirements
- You must be female. SheDrives is an exclusively female-driver platform.
- You must be at least 21 years of age.
- You must hold a valid Nigerian driver’s licence (FRSC-issued) for your vehicle category.
- You must have at least 2 years of active driving experience.
- You must have no criminal convictions for violence, sexual offences, fraud, or drug-related offences.
- You must be physically and mentally fit to drive safely.
4.2 Vehicle Requirements
Not more than 10 years old from the year of manufacture.
Current VIO certificate and valid vehicle registration documents.
Valid compulsory third-party motor vehicle insurance (at minimum). Certain service categories may require comprehensive insurance.
Valid Hackney Permit or equivalent permit for your area.
Must pass SheDrives’ onboarding vehicle inspection.
Clean, hygienic, and maintained to a standard suitable for carrying passengers.
4.3 Documents You Need to Provide
- Valid National ID, International Passport, or Voter’s Card.
- Your National Identification Number (NIN) for identity verification.
- Valid Nigerian driver’s licence.
- Vehicle licence / registration certificate.
- Vehicle insurance certificate.
- Proof of address (utility bill or bank statement not older than 3 months).
- A clear passport photograph.
- Any additional documents SheDrives may require.
5. Onboarding & Verification
Before you can drive on the platform, you must complete our onboarding process:
- Submit and verify all required documents.
- Pass a background check.
- Pass a vehicle inspection.
- Complete mandatory orientation and safety training.
SheDrives may decline any application without giving a reason. All approvals are at SheDrives’ sole discretion. SheDrives will periodically re-verify your documents. If any document lapses or is revoked, you will be suspended immediately until it is renewed.
6. Account Security
SheDrives is passwordless — you sign in with your phone number and a one-time code (OTP). Your account is personal to you. You must:
- Keep your phone secure and never share your one-time code (OTP) with anyone.
- Contact us immediately at support@shedrivesng.com if you suspect your account has been accessed without your permission.
- Never allow another person to use your Driver-Partner account.
SheDrives will never ask for your one-time code (OTP) by email, phone, or SMS. Do not share it with anyone. Watch out for phishing and scam attempts.
7. Your Obligations as a Driver-Partner
7.1 Service Standards
You must:
- Be professional, courteous, and respectful to all Riders at all times.
- Arrive at pickup locations on time.
- Follow the route shown in the App, or the safest reasonable route if the Rider requests a change.
- Keep your vehicle clean, hygienic, and comfortable at all times.
- Ensure air conditioning or windows are working for passenger comfort.
- Only use a mobile phone with a hands-free device while driving.
- Not smoke, vape, or consume alcohol before or during any ride.
- Only carry passengers booked through the App.
- Never share your login credentials or allow another person to use your account.
- Collect only the fare shown in the App. Do not demand or accept extra payment beyond that fare.
- Report any safety incident, accident, or criminal activity to SheDrives immediately through the App or at support@shedrivesng.com.
7.2 Safe and Lawful Driving
At all times you must:
- Comply with the FRSC Highway Code and all Nigerian road traffic laws.
- Not drive under the influence of alcohol, drugs, or any substance that affects your ability to drive.
- Ensure every passenger is wearing a seatbelt before starting a Trip.
- Ensure children are in age-appropriate restraints.
- Not drive while fatigued, unwell, or otherwise unfit.
- Keep your mobile phone inactive (or hands-free only) while driving.
7.3 Document & Insurance Compliance
You must keep all required licences, registrations, insurance policies, and permits active and valid at all times. You must notify SheDrives immediately if any document is suspended, revoked, or expires.
7.4 Female-Only Commitment
SheDrives is exclusively a female-driver platform. Misrepresenting your gender during registration, or allowing a male to operate your account, is a serious breach of these Terms and will result in immediate and permanent deactivation.
8. Service Tiers
Your account is assigned a ride tier based on your vehicle and verification status. The tiers are:
Affordable everyday rides in standard vehicles. Immediate and scheduled bookings.
More comfortable rides in higher-rated cars. Immediate and scheduled bookings.
Our premium tier — top-tier vehicles and drivers. Immediate and scheduled bookings.
9. Fares & Payments
9.1 How Fares Work
SheDrives sets the fares shown to Riders in the App, based on the ride tier and the time and distance of the Trip. The Rider pays you DIRECTLY — by cash or bank transfer — at the end of the Trip. SheDrives does not collect, hold, or process ride payments on your behalf.
9.2 Your Earnings
You keep 100% of the fares you collect from Riders. SheDrives does NOT take a per-trip commission. Because Riders pay you directly, SheDrives never deducts from your earnings.
9.3 Platform Subscription
Access to the Platform requires an active SheDrives subscription. The available plans and their prices are shown in the App. Your subscription renews automatically until you cancel. If you cancel, you keep access until the end of your current paid period, after which your account becomes inactive until you subscribe again. You can view your payment history and manage your subscription in the App at any time.
9.4 Your Tax Responsibilities
You are solely responsible for declaring and paying all taxes on your income, including personal income tax and any applicable VAT. SheDrives does not deduct, remit, or file taxes on your behalf.
10. Ratings & Performance
Riders rate you after each completed Trip on a scale of 1 to 5 stars. Your average rating over a rolling 365-day period is visible to Riders before they accept a match, and is used by SheDrives to monitor platform quality.
You are expected to maintain the minimum rating threshold communicated during onboarding. If your rating falls below the threshold, we will:
- Send you a formal notice with written feedback.
- Give you an opportunity to respond and improve.
- Provide performance improvement resources and guidance.
- Move to temporary suspension or permanent deactivation if standards are not met.
SheDrives will always give you notice and an opportunity to respond before any deactivation based on ratings.
11. Prohibited Conduct
The following are strictly prohibited and may result in immediate account deactivation and/or referral to law enforcement:
- Demanding or accepting payment above the fare shown in the App.
- Asking Riders to book rides outside the SheDrives platform.
- Any form of harassment, verbal abuse, threatening behaviour, or intimidation toward Riders or anyone else.
- Recording a Rider or anyone in the vehicle without their explicit consent.
- Sharing, falsifying, or manipulating trip data, GPS information, or ride records.
- Carrying passengers not booked through the App.
- Abandoning a Rider mid-trip without a valid reason.
- Using the App while your account is suspended.
- Providing false information during registration or any update.
- Operating an unlicensed, uninsured, or unroadworthy vehicle.
- Impersonating another person or creating a false account.
- Tampering with the ratings system or soliciting ratings from Riders.
- Using the Platform for any unlawful purpose.
12. Privacy & Data Protection
SheDrives collects and uses your personal data in accordance with the Nigeria Data Protection Act 2023 (NDPA) and our Privacy Policy. Data we collect includes:
- Your name, gender, date of birth, and contact details.
- Government-issued ID documents and your NIN.
- Vehicle information and inspection records.
- Location data (during active Trips only).
- Trip history and performance data.
- Your bank account details (so Riders can pay you directly).
Your data is stored securely and used only for platform operations. You have rights over your data under the NDPA 2023, including the right to access, correct, delete, or transfer it. To exercise these rights, contact our Data Protection Officer at support@shedrivesng.com.
13. Our Liability to You
SheDrives provides a technology intermediation platform. We are not liable for:
- Accidents, injuries, or property damage arising from your operation of a vehicle.
- Traffic violations or fines you incur during rides.
- Mechanical failures of your vehicle.
- Loss of earnings due to platform downtime, low demand, or account suspension.
- Any indirect, special, or consequential loss.
To the maximum extent permitted by Nigerian law, SheDrives’ total liability to any Driver-Partner shall not exceed the total subscription fees paid by that Driver-Partner in the 3 months before the event giving rise to the claim.
14. Your Indemnification Obligations
You agree to protect SheDrives against any claims, losses, or costs (including legal fees) that arise from:
- Your breach of these Terms or any Nigerian law.
- Your unlawful or unauthorised use of the Platform.
- False or misleading information you provided to SheDrives or a Rider.
- Any third-party claim relating to your conduct on the Platform.
15. Force Majeure
Neither party is responsible for delays or failures caused by events outside their reasonable control, such as natural disasters, war, government orders, pandemics, or utility failures. If this happens, the affected party must notify the other as soon as possible and take reasonable steps to resolve the situation.
16. Account Suspension & Deactivation
16.1 Temporary Suspension
SheDrives may temporarily suspend your account while investigating:
- Safety incidents or complaints.
- Unusual account activity.
- Expired or lapsed documents.
During a suspension, you may be unable to access the Platform. We will notify you as soon as the investigation is concluded.
16.2 Permanent Deactivation
SheDrives may permanently deactivate your account for:
- Verified harassment, assault, or criminal behaviour.
- Gender misrepresentation or account sharing.
- Fraudulent activity.
- Repeated or serious breach of these Terms.
- A criminal conviction relevant to passenger safety.
Sexual harassment, sexual assault, physical violence, or any criminal conduct will result in immediate permanent deactivation and a report to the Nigerian Police Force. SheDrives will cooperate fully with any investigation.
16.3 Notice & Your Right to Appeal
For deactivations other than zero-tolerance offences:
- You will receive 7 days’ written notice where minimum performance standards are consistently not met (after a prior warning).
- You will receive 14 days’ written notice for other non-misconduct reasons.
- You have the right to appeal any suspension or deactivation within 14 days of receiving notice.
- Submit your appeal by email to support@shedrivesng.com with the reasons and any supporting evidence.
- SheDrives will acknowledge your appeal within 5 business days and respond fully within 14 business days.
17. Dispute Resolution
Step 1 — Contact Us First
If you have a complaint, contact SheDrives first. We will acknowledge within 24 hours and aim to resolve within 10 business days. Contact us in the App or at support@shedrivesng.com.
Step 2 — Negotiation
If the complaint is not resolved, both parties will try to resolve it through good-faith discussion within 30 days of a written notice of dispute.
Step 3 — Mediation & Arbitration
If negotiation fails, either party may refer the matter to mediation. If mediation does not resolve it within a further 30 days, the dispute will be settled by binding arbitration under the Arbitration and Mediation Act 2023 (AMA). The seat of arbitration is Lagos, Nigeria, and the language is English. The arbitral award is final and binding. Nothing here prevents either party from seeking urgent court relief in Nigeria if necessary.
Governing Law: These Terms are governed by the laws of the Federal Republic of Nigeria.
18. Changes to These Terms
SheDrives may update these Terms at any time. For important changes, we will notify you at least 14 days before they take effect via the App or by email. Minor corrections may take effect immediately. Your continued use of the App after the effective date means you accept the updated Terms.
If you do not agree with any change, stop using the App and email support@shedrivesng.com to close your account.
19. General Provisions
- Entire Agreement. These Terms, together with the Privacy Policy, are the full agreement between you and SheDrives for your use of the Platform.
- Severability. If any part of these Terms is found to be unenforceable, the rest of the Terms continue to apply.
- No Waiver. If SheDrives does not enforce a right under these Terms, that does not mean the right is waived.
- No Assignment. You may not transfer your rights or obligations under these Terms without SheDrives’ written consent.
- Language. These Terms are written in English. If translated, the English version prevails.
- Relationship. These Terms do not create an employment, partnership, or agency relationship between you and SheDrives.
